Stern Warning in lieu of Prosecution

A stern warning in lieu of prosecution was issued and accepted by Spring College International (SCI) for publishing an advertisement with false or misleading statements that may influence potential students. This is in contravention of section 46(1) and punishable under section 46(3) of the Private Education Act Cap 247A.

The contravening statements were as follows:

“… a range of joint, double and concurrent degree programmes with some of the best universities in the world. As a leading research-intensive university, there are many opportunities for our students to interact and work with faculty and graduate students at the cutting edge of knowledge creation in a wide range of fields…”

Note: SCI was neither a university nor offering any degree programme at the time when the offence was committed.

“Our teaching department consists of lecturers, language experts, and language consultants. Most of them hold related qualifications. Some of them are professors…” 

Note:  None of the staff in SCI was conferred the title of a professor by any institution of higher learning at the time when the offence was committed.

Manager/director of Kalaibharathi International School Pte Ltd (KBIS)

Conviction

The accused pleaded guilty and was sentenced for:

  1. Knowingly assisting an unregistered school provide private education under Section 34(1)(a) read with Section 34(3) and punishable under Section 61(2) of the Private Education Act Cap 247A. The Court imposed a fine of $10,000 and in default 10 weeks’ jail.

  2. Failing to ensure that KBIS complied with a lawful direction to refund students their course monies under Section 34(6) read with Section 34(8) and punishable under Section 61(2) of the Private Education Act Cap 247A. The Court imposed a fine of $8,000 and in default 8 weeks’ jail.

The accused was given and accepted a stern warning in lieu of prosecution for:

  1. Knowingly assisting an unregistered school provide private education. This is a contravention of Section 34(1)(a) read with Section 34(3) of the Private Education Act Cap 247A.

  2. Failing to ensure that KBIS complies with a lawful direction to refund students their course monies. This is a contravention of Section 34(6) read with Section 34(8) of the Private Education Act Cap 247A.
